Terms and Conditions of Sale

FANTINO — BESPOKE TAILORING HOUSE —

Article 1 — Purpose and scope

These Terms and Conditions of Sale govern all sales of bespoke garments and associated services carried out under the Fantino® brand (hereinafter "Fantino" or "the House"), operated by the company LakeHouse S.à r.l-S, whether the order is placed via the site fantinolux.com, by telephone, by email, at the showroom at 25B Boulevard Royal in Luxembourg, or during a home or corporate appointment.

Any order implies the customer's full and unreserved acceptance of these T&Cs. The customer's own purchasing conditions, if any, are not enforceable against the House, unless previously agreed in writing.

Article 3 — Products and services

Fantino offers bespoke garments — suits, jackets, waistcoats, trousers, shirts, coats and associated accessories — as well as the related tailoring services: measurement taking, fittings, alterations, style advice and pattern retention.

Each piece is made according to the customer's personalization choices: fabric, cut, lining, buttoning, buttonholes, pocket configuration, monogram and finishing details. Due to this personalization, each order constitutes goods made to the consumer's specifications or clearly personalized within the meaning of Article L. 222-9, 3° of the Luxembourg Consumer Code and Article 16(c) of Directive 2011/83/EU.

Article 4 — Prices

Prices are shown in euros (€), inclusive of all taxes for customers established in the Grand Duchy of Luxembourg and in the European Union. For deliveries outside the EU, prices may be shown exclusive of tax; customs duties and local taxes remain the customer's exclusive responsibility.

Any delivery costs are specified before final validation of the order. The House reserves the right to change its prices at any time; the applicable price is the one in force on the day the order is validated.

Article 5 — Ordering process

The order may be formalized in one of the following ways:

  • At the showroom, after measurements are taken and the fabric is chosen by a Fantino tailor.
  • At home or at the workplace, during a bespoke appointment.
  • Via the online configurator on fantinolux.com, supplemented by a fitting appointment or a validated measurement sheet.

Every order is confirmed by email and is only firm after receipt of the deposit or full payment. The House reserves the right to refuse any order showing an obvious anomaly (price, information, specifications) or from a customer with whom there is a prior unresolved dispute.

Article 6 — Payment

The accepted payment methods are: bank card (Visa, Mastercard, American Express), SEPA transfer and PayPal. Transactions are secured by SSL encryption and operated by approved providers; the House does not store any banking data on its servers.

Unless otherwise agreed in writing, the order gives rise to payment:
• of a deposit of fifty percent (50%) upon confirmation of the order;
• of the balance before delivery or at the final fitting.

For corporate orders of significant volume, specific payment terms may be agreed by quotation.

Article 7 — Making time and delivery

Due to the bespoke nature of each piece, the standard making time is three (3) to four (4) weeks from validation of the order and receipt of the deposit. This time frame excludes any intermediate fittings.

For certain special orders — rare fabrics, multi-layer pieces, event coordinates — a longer time may apply; it is then communicated to the customer before validation. Accelerated lead times may be offered on an exceptional basis, for an additional fee and subject to acceptance by the workshop.

Any time frame is indicative and cannot give rise to cancellation or damages in the event of reasonable overrun, in particular in the event of a constraint related to fabric supply or additional fittings required. Delivery terms are specified in the Delivery Policy, an integral part hereof.

Article 8 — Right of withdrawal — Exclusion for personalized products

ESSENTIAL POINT TO BRING TO THE CUSTOMER'S ATTENTION

In accordance with Article L. 222-9, 3° of the Luxembourg Consumer Code and Article 16(c) of Directive 2011/83/EU, the fourteen (14) day right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalized. All Fantino bespoke garments fall under this exception. The customer expressly acknowledges and accepts, by validating their order, that it is not subject to withdrawal.

This exclusion does not affect the customer's legal warranties, nor the fitting and alteration policy described in article 10 and in the Return Policy.

Article 9 — Returns and refunds

Returns are governed by the Return, Refund and Alteration Policy, an integral part hereof. In summary:

  • No return is accepted for a bespoke garment that has been worn, washed, ironed, altered outside Fantino, or modified by the customer.
  • Non-personalized accessories and items as-is (ready-to-wear, where applicable) may be returned within fourteen (14) days of receipt, provided they are in their original condition, unworn and unaltered, with intact labels.
  • In the event of a manufacturing defect or an error attributable to Fantino, the House undertakes to take back, repair or remake the piece at its own expense.

Article 10 — Adjustments and workmanship defects

Fantino guarantees the quality of its workmanship and the fit of its pieces. To this end:
• Any alteration made necessary by a fitting defect attributable to the House is carried out free of charge in the Fantino workshop.
• A first series of comfort alterations, at delivery, is offered for every first order.
• Any modification requested by the customer not related to a fitting defect (subsequent change in body shape, change of taste) may be carried out by Fantino according to a quote.
• Any intervention by a third party on a Fantino garment causes the customer to lose the benefit of free adjustments and alterations.

Article 11 — Legal warranties

The products benefit from the legal warranties applicable in Luxembourg: warranty of conformity (Articles L. 212-1 et seq. of the Consumer Code) and warranty against hidden defects. For any claim under these warranties, the customer contacts contact@fantinolux.com.

Article 12 — Intellectual property

All the elements appearing on fantinolux.com and on the House's media (brand, logo, photographs, videos, texts, sketches, patterns) are the exclusive property of LakeHouse S.à r.l-S or its rightful owners. Any reproduction, representation, adaptation or exploitation, in whole or in part, without prior written authorization, is prohibited.
The Fantino® trademark is the subject of an application for registration with the Benelux Office for Intellectual Property (BOIP) under number 1547041, in classes 25 and 40. All the elements appearing on fantinolux.com and on the House's media (brand, logo, photographs, videos, texts, sketches, patterns) are the exclusive property of LakeHouse S.à r.l-S or its rightful owners.

Article 13 — Protection of personal data and body measurements

The House draws the customer's attention to the fact that the execution of a bespoke order involves the collection and processing of body measurement data (chest, shoulder, waist, hip circumference, leg length, etc.), which may, depending on the circumstances, fall under categories of sensitive data.
These data are processed with particular rigour and solely for the purposes of making, alteration and pattern archiving. Their processing is described in detail in the Privacy Policy accessible on fantinolux.com, which forms an integral part hereof.

Article 14 — Force majeure

Neither party may be held liable for a failure resulting from an event of force majeure, as defined by Luxembourg case law, including but not limited to: natural disaster, general strike, pandemic, global disruption of raw material supply, armed conflict, restrictive administrative measures.

Article 15 — Mediation and dispute resolution

In the event of a dispute, the customer is invited to contact the House first at contact@fantinolux.com. Failing an amicable solution, a consumer customer residing in the European Union may use the European online dispute resolution platform available at https://ec.europa.eu/consumers/odr/.

Article 16 — Applicable law and jurisdiction

These T&Cs are governed by Luxembourg law. Any dispute relating to their interpretation or execution falls, failing an amicable agreement, within the exclusive jurisdiction of the courts of the district of Luxembourg, without prejudice to the mandatory provisions protecting consumers.

Article 17 — Modification of the T&Cs

The House reserves the right to modify these T&Cs at any time. The T&Cs applicable to an order are those in force on the day it is validated. The current version can be consulted at any time on fantinolux.com and may be archived by the customer.
